# Terms of Service These terms govern your use of SMS Nitro, a service that sells prepaid temporary and rented phone numbers for receiving SMS verification codes. By creating an account or using the service you agree to them. Last updated: 30 October 2026. ## 1. Who we are SMS Nitro is operated by B. FLORES ALVARIZA LTDA (CNPJ 62.639.487/0001-04), Pelotas, RS, Brazil ("SMS Nitro", "we", "us"). "You" means the person or organization using the service; if you use it on behalf of a company, you confirm you are authorized to accept these terms for it. The Privacy Policy, Acceptable Use Policy, Refund Policy and Cookie Policy are part of this agreement. ## 2. Eligibility You must be at least 18 years old and legally able to enter into a binding contract. You may not use the service if you are barred from doing so under the laws that apply to you, or if we previously suspended or closed your account. ## 3. Your account You need an account to buy numbers, created with an email and password or with Google Sign-In. You agree to give accurate information and keep it up to date. You are responsible for keeping your password and API keys secret and for all activity under your account; tell us immediately if you believe either has been compromised. One person may not run several accounts to get around limits, promotions or enforcement actions. ## 4. The service SMS Nitro lets you reserve a phone number for a short period (an activation, up to 20 minutes) or for a fixed period (a rental, from 24 hours to 30 days) to receive SMS from apps and websites. Numbers are sourced from third-party carrier and line providers. Messages received while the number is yours are shown in your dashboard and, if you use it, through the API. While an activation is active you can request additional codes on the same number at no extra cost. The service works in the browser; no app, SIM card or contract is needed. ## 5. Balance and billing - The service is prepaid. You top up by card through Stripe (Visa, Mastercard, Amex, Apple Pay, Google Pay) or with crypto (USDC or SOL on Solana). The minimum top-up is $5. - Card top-ups carry a 10% processing fee, added on top and shown before you pay. The fee is not refundable except where the law requires it. Crypto top-ups are credited after on-chain confirmation; you are responsible for sending the correct token, on the correct network, to the address shown. Payments sent otherwise may be lost. - When you buy an activation its price is frozen from your balance, not charged. You are charged only if an SMS arrives. If none arrives before the number expires, or you cancel before a code arrives, the held amount returns to your balance automatically. Once a code has been delivered, the purchase is final. - Rentals are charged in advance for the chosen period and replaced or credited only under the conditions in the Refund Policy. - Prices are shown before each purchase and may change at any time, but a change never affects a number you already bought. There is no subscription and your balance does not expire. Balance is prepaid credit for use on SMS Nitro: it is not a bank deposit, earns no interest and cannot be transferred to another user. Promotional or bonus credit has no cash value and follows the conditions stated with the offer. ## 6. Acceptable use You may use the service only for lawful purposes and in line with the Acceptable Use Policy. Among other things, you may not use it for fraud, impersonation, harassment, spam, mass creation of fake accounts, evading bans, or accessing financial, banking or government accounts that are not yours. You are responsible for complying with the terms of any third-party app or website you use a number with. ## 7. API access - After your first confirmed top-up you can create an API key for the REST API and the SMS-Activate-compatible endpoint. API purchases follow the same billing, refund and acceptable use rules as the dashboard. - Requests made with your key are treated as made by you. Keep keys secret. - Respect rate limits; do not send requests designed to overload, probe or disrupt the service, scrape the catalog, or resell access in violation of these terms. - We may change, rate-limit or retire endpoints and revoke keys that are abused or compromised. ## 8. Availability and acceptance by third parties Countries, apps and prices depend on our carrier partners and change constantly; we do not guarantee that a given app or country will be offered at all times. We do not control the apps and websites that send codes and cannot guarantee that an app will accept a number, send a code to it, or keep an account created with it active. Apps may block number types, limit sign-ups or ask for additional checks at their own discretion. ## 9. Numbers are temporary An activation number is yours only for its window; after it expires you lose access to it and it may later be reassigned. A rental is yours for the paid period and can be extended before it ends; after it ends it is released. Do not use an activation number as the recovery phone, two-factor method or primary contact of an account you need long term; if an app later sends a code to it, you will not receive it. We are not responsible for loss of access to third-party accounts linked to a released number. ## 10. Suspension and termination You may stop using the service and ask us to close your account at any time by writing to contact@smsnitro.com. We may suspend or close your account, revoke API keys or refuse a purchase if we reasonably believe you have broken these terms or the Acceptable Use Policy, if required by law, or to protect the service, our providers or other people. The handling of any remaining balance in those cases is described in the Acceptable Use Policy and the Refund Policy. Sections that by their nature should survive termination (disclaimers, limitation of liability, indemnity) continue to apply. ## 11. Disclaimers The service is provided "as is" and "as available". To the maximum extent permitted by law we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the service will be uninterrupted or error-free, that codes will arrive within any particular time, or that any number will work with any particular third-party service. ## 12. Limitation of liability To the maximum extent permitted by law, SMS Nitro and B. FLORES ALVARIZA LTDA are not liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, data, accounts, goodwill or business opportunities arising from your use of the service. Our total liability for any claim is limited to the amount you paid to SMS Nitro in the 3 months before the event that gave rise to it. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you. ## 13. Indemnity You agree to defend, indemnify and hold harmless B. FLORES ALVARIZA LTDA, its officers, employees and partners from claims, losses, damages and expenses (including reasonable legal fees) arising from your use of the service, your violation of these terms or the Acceptable Use Policy, or your violation of any law or third-party right. ## 14. Changes to these terms We may update these terms. The date at the top shows the latest version; significant changes are announced by email or in the dashboard. Continuing to use the service after a change takes effect means you accept it. ## 15. Governing law These terms are governed by the laws of Brazil, with the courts of Pelotas, RS, Brazil, unless mandatory consumer protection law where you live gives you the right to bring a claim in your local courts. Before any formal dispute, contact us so we can try to resolve the issue informally. If any part of these terms is unenforceable, the rest remains in effect; our failure to enforce a provision is not a waiver of it. ## 16.
